In consideration of being permitted to participate in lineman training courses, workshops, assessments, or any other event offered by Ohio Rural Electric Cooperatives, Inc. (“OREC”), including, but not limited to, the COLT Power Lineworker Certification Program, Journeyman Refresher Program, or, as applicable, any other event held by OREC at the location known as COLT Field (collectively, the “OREC Training Programs”), the undersigned hereby agrees to the following:
The Undersigned hereby releases, waives, discharges and covenants not to hold liable, OREC, its owners, directors, agents or employees (hereinafter referred to as 'releasees’) from any and all liability to the undersigned for any loss of or damage to the undersigned, and any claim or demands therefore on account of injury to the person or property or resulting in injury to or death of the undersigned, however caused by the negligence of the releasees or otherwise, while the undersigned is in, upon, or about the premises or any of its facilities or equipment, therein.
The Undersigned hereby agrees to indemnify, save and hold harmless the releasees from any loss, liability, damage or cost he/she may incur due to the presence of the undersigned in, upon or about the OREC premises or in any way associated with training, observing or using any facilities or equipment of OREC whether caused by the negligence of the releasees or otherwise.
The Undersigned hereby assumes full responsibility for the risk of bodily injury, death or property damage due to the negligence of releasees or otherwise while in, about or upon the premises of OREC and/or while using the premises or any facilities or equipment hereon.
The Undersigned hereby attests that he/she is in acceptable health and physical shape to utilize the facilities and/or classes offered at OREC.
The Undersigned hereby acknowledges that OREC highly recommends that any participants in OREC Training Programs obtain adequate health insurance prior to beginning such training. The Undersigned understands by signing this document that should the undersigned forego the recommendations of OREC regarding obtaining health insurance, that the undersigned will be fully responsible for any and all medical bills associated with any injuries or conditions obtained while on OREC’s premises and will hold OREC harmless against such.
The Undersigned further expressly agrees that the foregoing Release and Waiver is intended to be as broad and inclusive as is permitted by the law of the State of Ohio and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.
The Undersigned has read and voluntarily signs this Release and Waiver of Liability, and further agrees that no oral representations, statements or inducements apart from any contained in this written agreement, have been made.
